Waiver Agreement Policy

1. Acknowledgment of Research Use Only

By purchasing research compounds from Pure Health Peptides, I, the undersigned customer (“Customer”), acknowledge and agree that:

All products are strictly for laboratory research purposes only and are expressly prohibited from human consumption, veterinary use, or any diagnostic or therapeutic purpose.These products have not been evaluated or approved by the U.S. Food and Drug Administration (FDA) or any other regulatory body. It is my sole responsibility to handle, store, and use these compounds in compliance with all applicable laws, safety protocols, and industry best practices, including maintaining appropriate storage conditions, security measures, and documentation of all research uses.

I acknowledge that failure to do so voids all Pure Health Peptides’ obligations under this agreement. 

2. Age Verification & Legal Compliance

I confirm that I am at least 21 years of age and legally permitted to purchase research compounds in my jurisdiction.

I acknowledge that Pure Health Peptides does not sell products to individuals under 21 years old, and I agree to provide valid government-issued identification upon request. I am solely responsible for complying with any applicable local, state, or federal regulations regarding the purchase, possession, and use of these compounds.

3. No Medical Claims & No Warranties

Pure Health Peptides makes no medical claims, express or implied, about the safety, effectiveness, or intended use of its products. No guarantees or warranties are provided regarding research outcomes, product efficacy, or results.

The products are provided “AS IS” and “AS AVAILABLE,” but will conform, at the batch level, to the written specifications and Certificates of Analysis provided by Pure Health Peptides for that production lot. Except for batch-level conformance to such written specifications, Pure Health Peptides disclaims all other warranties, express or implied, to the fullest extent permitted by law, including without limitation any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Nothing in this Agreement excludes any warranty that cannot legally be disclaimed under applicable law.

4. Assumption of Risk & Release of Liability

By purchasing, possessing, or using products from Pure Health Peptides, I assume all risks and agree that:

To the fullest extent permitted by law, Pure Health Peptides shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages arising from the use, misuse, storage, handling, or disposal of its products. In no event shall Pure Health Peptides’ total liability exceed the amount paid for the product giving rise to the claim. Nothing in this Agreement limits liability for fraud, intentional misconduct, willful injury, or any liability that cannot legally be disclaimed under California law. I waive any legal claims against Pure Health Peptides, its officers, employees, and affiliates arising from the purchase, handling, use, misuse, or disposal of these research compounds.

I accept full responsibility for ensuring compliance with all applicable laws and regulations.

5. Indemnification

I agree to indemnify and hold harmless Pure Health Peptides, its officers, employees, and affiliates from any:

Claims, liabilities, damages, losses, costs, expenses (including reasonable attorneys’ fees), fines, penalties, and regulatory actions resulting from my purchase, possession, storage, handling, use, or disposal of these compounds, or any violation of this agreement.

Legal actions arising from misuse, injury, property damage, or third-party claims related to these products. 

6. Gated Access & Customer Verification

            6.1 I understand that access to product selection and checkout is gated by an age verification and research-use-only agreement.

            6.2 I acknowledge that checkout requires KYC information including name, email, and a one-time-password (OTP) for secure login and compliance verification.

            6.3 I accept that my account may be restricted or suspended if false information is provided or misuse is suspected.

7. Binding Agreement & Governing Law

This agreement is binding upon myself, my heirs, executors, administrators, successors, and assigns.

Severability: If a court finds any provision of this agreement invalid or unenforceable, the remainder of this agreement shall be interpreted to best effect the intent of the parties.

This Agreement and its interpretation is governed by the laws of the state of California.

The parties consent to the exclusive jurisdiction and venue of the state and federal courts located in San Diego County, California, for any dispute arising out of or relating to this Agreement, except that either party may bring an individual claim in small claims court if it qualifies. Each party knowingly and voluntarily waives any objection to personal jurisdiction, venue, or forum in these courts, including objections based on inconvenience or conflict of laws.

 

8. Acknowledgement & Acceptance

By proceeding with my purchase, I confirm that I have read, understood, and voluntarily agree to this Indemnity Waiver Agreement. I acknowledge that my electronic acceptance constitutes a valid and legally binding signature under the California Uniform Electronic Transactions Act (UETA) and the federal Electronic Signatures in Global and National Commerce Act (ESIGN). I further agree that electronic and printed versions of this Agreement shall be admissible to the fullest extent permitted by law in any judicial or administrative proceeding.

By accessing or using this website or purchasing any product from Pure Health Peptides, I expressly acknowledge and agree to the Company’s Terms & Conditions, Privacy Policy, and Disclaimer, which are incorporated into this Agreement by reference and available at www.purehealthpeptides.com/terms, www.purehealthpeptides.com/privacy, and www.purehealthpeptides.com/disclaimer. I understand that material changes to these policies will be communicated through website notices or email and will become effective only after such notice is provided. Continued use of the website without such notice does not constitute acceptance of material changes; affirmative consent may be required where legally necessary.
